Should Fake Weed Be Legal In Your State?

Should “fake weed” be legal in your state? We’d love to know.

This has been a hot topic of discussion since May 2022 with a landmark ruling from the Federal Court of Appeals.

The Federal Ninth Circuit Court of Appeals recently announced that they have found Delta-8 THC (A.K.A “fake weed”) to be a legal substance(1).

This is due to a loophole found in a 2018 Farm Bill(2) that led to the substance being seen as federally legal because this “pot lite” derives from the Hemp plant and NOT marijuana… However, some states still think that Delta-8 THC should be illegal on a state level.

So who is right?

The state court? Or the federal court?

And why do they disagree?

Well, on the state level, it’s kept illegal in some parts of the country due to the intoxicating effects of the THC gummies, vape juices, and flowers, and how the effect is kind of similar to smoking marijuana.

With the main difference being that the effect felt is more like a clear headed and “in-your-body sensation(3)“. It’s much calmer and controllable than traditional marijuana.

On the Federal level, they acknowledge that the reason why marijuana is illegal is the plant itself, not the intoxication. After all, getting drunk is legal, right?

If the hemp plant is not illegal, then why should the THC variant derived from it be made illegal?

Many people across the United States are fighting for Delta-8 THC to be made widely legal, because it provides a safe and clean alternative to marijuana to be used for it’s huge beneficial properties, including(4):

  • Seizure control
  • Improved appetite
  • Help with sleep
  • No harsh scent
  • Stress and anxiety relief
  • Ability to enjoy the benefits without needing to smoke the product.

But ultimately, we want to hear your opinion. Choose whether or not to “make Delta-8 illegal” or “make Delta-8 legal”.
